BY USING THIS WEBSITE OR ITS PRODUCT AND SERVICES, YOU AGREE TO BECOME BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. These terms and conditions (“Terms and Conditions”) control your use of this website TrainingsTree(“Website”). In these Terms and Conditions, “TrainingsTree” is referred to as the “Company”, “us,” or “we.”
‘You’ refers to a user or a paying customer. If you are a company or another person who gives access to company products, you agree to take responsibility in full in case of damages or indemnification that could properly lie against the customer.
The TrainingsTree website (the ‘Site’), the educational services made available through the site and the content (the ‘Products’) are owned, operated and maintained, as applicable, by TrainingsTree (‘we’, ‘our’, ‘us’, or the ‘Company’). The Site, Products and Content are, collectively, the ‘Company Products’.
By (a) using or accessing the Company Products, including, but not limited to downloading or accessing, (b) offering a Course through the Site or through Software; you agree to the terms and conditions set forth in these Terms of Use (the “Terms”)
By using this website or its Products and Services, You Agree and Warrant that you have read, understood, and agreed to be Bound by these terms. We may not hire or employ Teachers/Instructors nor are we responsible or liable for any interactions involved between the Instructors and their respective clients. We are not responsible for disputes, claims, losses, injuries, or damage of any kind that might arise out of or relate to conduct of Instructors or Students, including, but not limited to, any Student’s reliance upon any information provided by an Instructor.
The Products enable students (“Learners”) to connect with independent contractor instructors (the “Instructors”) who provide live and recorded instruction, tutoring, and learning services in Our proprietary online classrooms (the “Courses”). Students and Instructors are, collectively, “Users.” The Products include, without limitation, facilitating and hosting Courses and supporting materials,
You may only access the Products for lawful purposes. You are solely responsible for the knowledge of and adherence to any and all laws, rules, and regulations pertaining to Your use of the Products. You agree not to use the Products or the Company Content (as defined ) to recruit, solicit, or contact in any form Instructors or potential users for employment or contracting for a business not affiliated with us without Our advance written permission, which may be withheld in Our sole discretion. You assume any and all risks from any meetings or contact between You and any Instructors or other Users of the Products.

Transaction Terms
To make a transaction on TrainingsTree website, you may have to pay for that transaction. There are certain products which require additional Terms and Conditions which you have to agree to before you make the purchase. Please pay close attention to your payment details such as total bill, taxes, shipping costs, and discounts. Invoice of the order placed can be viewed at email copy is sent to you during the purchase. If a delegate has completed the course and is eligible for a certificate, then same shall be delivered to the address provided by the delegate within specified time of the course varies from 30 to 60 days .
WE MAKE NO WARRANTIES OF ANY KIND, EXPRESSED OR IMPLIED, WITH RESPECT TO ANY PRODUCTS OR SERVICES SOLD ON OR THROUGH TRAININGSTREE.
No additional or different terms contained in any purchase order, document, transmission or other communication shall be binding upon TrainingsTree unless agreed to by TrainingsTree in writing. TrainingsTree reserves the right to modify, change without prior notice and in its sole discretion, to limit the order quantity on any item and to refuse service to anyone.
Subscription Services
You will be allowed to subscribe to a particular course or collection of courses (“Subscription Services”) and will be charged automatically, depending on payment frequency chosen by you, such as monthly/quarterly/yearly, as may be applicable.
You will be permitted to freeze or schedule the freeze of the Subscription Services at anytime and TrainingsTree shall not charge you for any such opted Subscription Services according to the payment cycle. Further, the Subscription Services, access will be revoked if the user opts to freeze the subscription. You will have the option to re-subscribe to the particular Subscription Services again and the payment cycle will start accordingly.
Please note that Subscription Services discounts and any Subscription Services are only a limited time special subscription promotions in effect apply only to eligible items displaying the offer message on the Subscription Services item information pages, and then only if you select the Subscription Services. Subscription Services are will last only till a particular period of time, and there is no refund for the service done what so ever as may be specified on the relevant page. Special limited time subscription promotions only apply during their effective dates.
TrainingsTree retains the rights to modify the Subscription Service from time to time, including by adding or deleting features and functions, in an effort to improve your experience. But we will not make changes to the Subscription Service that materially reduces the functionality of the Subscription Service provided to you during the Subscription Term. We might provide some or all elements of the Subscription Service through third party service providers.
If you register for a free trial of the Subscription Service, we will make the Subscription Service available to you on a trial basis, free of charge until the earlier of
(a) the end of the free trial period or
(b) the start date of your subscription. If we include additional terms and conditions on the trial registration web page, those will apply as well. During the free trial period, (i) the Subscription Service is provided “as is” and without warranty of any kind, (ii) we may suspend, limit, or terminate the Subscription Service for any reason at any time without notice, and (iii) we will not be liable to you for damages of any kind related to your use of the Subscription Service. Unless you subscribe to the Subscription Service before the end of the free trial, all of your data on the Subscription Service will be permanently deleted at the end of the trial, and we will not recover it. TrainingsTree shall not refund or in any ways discount, set off any amount once the trial period has ended if any. In case where You wish discontinue to paid Services, please login to your account(it is applicable to continuous service for multiple years , for but single year payment there no refund once the work has been done and punished and reviewed . Go to Profile>Manage Subscription, click on Subscription and Freeze the subscription to stop any further payments being made. or write to us after your term we will do so.
Valid credit cards are the only payment method accepted for Subscription Services purchases. The customer shall at all time use a credit card for the use of Subscription Services and upon the completion of the free trial period, you will be charged automatically without the requirement of any further approval or consent, such a period of the trial period shall be mentioned on the at the time of registration to the Subscription Services, TrainingsTree absolves any liability with regard to information of period of the free trial period.It is clarified that, once the Subscription Services are accepted the participants authorize TrainingsTree and any of its affiliates to debit the accounts at regular intervals as may be notified to the participants
Further, you will have the option of cancelling the Subscription Services during the free trial period,(this is not applicable to bonus time given if any and we are no more offering free trial from 1 April 2016) without incurring any charges for the same. To initiate the free trial, TrainingsTree shall charge you a token amount to ensure the validity of Credit Card. The token amount will be refunded automatically within 7 days. Further You may cancel your account with TrainingsTree by reaching out to [email protected],
Your Subscription Services will remain in effect until it is cancelled/ or term is ended. If you cancel your Subscription Services and then reactivate it, the discount applied to any Subscription Services item may not be the same discount in effect at the time of cancellation. If you reactivate a Subscription Services, it will be created with the same products with which you previously subscribed. If the Subscription Services discount percentage for such Subscription Services item changes, the new discount will be applied to your products of that item.
All fees are exclusive of taxes, which we will charge as applicable. You agree to pay any taxes applicable to your use of the Subscription Service. All fees are exclusive of any VAT, Service tax, GST or any other applicable law and tax deductions. If you are required to deduct or withhold any tax, you must pay the amount deducted or withheld as required by law and pay us an additional amount so that we receive payment in full as if there were no deduction or withholding.
LIMIT OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TRAININGSTREE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY PARTY OTHER THAN THE APPLICABLE TRAININGSTREE PARTY, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR CONTENT OR INFORMATION. IN NO EVENT SHALL TRAININGSTREE’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED TWENTY U.S. DOLLARS ($20 )(OR EQULLENT INDIAN INR) OR THE TOTAL AMOUNT OF FEES RECEIVED BY TRAININGSTREE FROM YOU FOR THE USE OF PAID SERVICES DURING THE PAST SIX MONTHS, WHICHEVER IS GREATER.
INDEMNITY
You agree to indemnify, defend, and hold harmless the TRAININGSTREE Parties from any and all claims, liabilities, expenses, and damages, including reasonable attorneys’ fees and costs, made by any third party related to: (a) your use or attempted use of the Services in violation of these Terms; (b) your violation of any law or rights of any third party; or (c) User Content, including without limitation any claim of infringement or misappropriation of intellectual property or other proprietary rights.

All prices, products, and offers of TrainingsTree website are subject to change without notice.
While we make sure to provide most accurate and up-to-date information, in some cases one or more items on our website may be priced incorrectly. This might happen due to human errors, digital images, technical errors, or a mismatch in pricing information received from our suppliers.
TrainingsTree reserves the right to change prices for all our products, offers, or deals. These changes are done due to market conditions, course termination, providers, price changes, errors in advertisements, and other mitigating circumstances. However, the price you paid at the time of purchase still holds for you.

Specific Obligations of Instructors/ Mentors
If You are instructing Students in connection with a Course You are an “Instructor/mentors” and the following additional
terms and conditions apply, and You represent, warrant and covenant that:
You are subject to the Company’s approval, which We may grant or deny in Our sole discretion;
You have the required qualifications, credentials and expertise, including without limitation, education, training, knowledge, and skill sets, to teach and offer the services You offer on and through the Site and the Products;
You will not upload, post or otherwise transmit any unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes or any other form of solicitation (commercial or otherwise) through the Products or to any User;
You will be responsible for all of Your Submitted Content, that You own or have the necessary licenses, rights, consents, and permissions, and have the authority to authorize Company, to reproduce, distribute, publicly perform (including by means of a digital audio transmission), publicly display, communicate to the public, promote, market and otherwise use and exploit any of Your Submitted Content on and through the Products in the manner contemplated by these this Instructor Agreement, and that no Submitted Content shall infringe or misappropriate any intellectual property right of a third party.
You will not post any inappropriate, offensive, racist, hateful, sexist, pornographic, false, misleading, infringing, defamatory or libelous content;
You will not use the Products for any business other than for providing tutoring, teaching and instructional services to Students;
You will not engage in any activity that will require Company to obtain any licenses from or pay any royalties to any third party, including, by way of example and not limitation, the payment of royalties for the public performance of any musical works or sound recordings;
You are over the age of 18 or, if not, you are between the ages of 13 and 17 and a third party parent or legal guardian has agreed to these Terms and the Instructor Terms and will assume responsibility and liability for Your performance and compliance hereunder.
You will not copy, modify or distribute Company Content except as permitted in this Instructor Agreement;
You shall respond promptly to Users seeking Your services and ensure a quality of service commensurate with the standards of Your industry and instruction services in general;
You will maintain Your enrollment and account information, and all such enrollment and account information shall be accurate;
You will not interfere with or otherwise prevent other Instructors from providing their services or Courses;
You will declare and pay applicable tax and other government due as required by law of the land you operate.
REFUND POLICY
Thank you for buying our courses. We try to ensure that our users have a rewarding experience while they discover, assess, and purchase our courses, whether it may be instructor-led or classroom training.
As with any online purchase experience, there are terms and conditions that govern the Refund Policy. When you buy a training course on TrainingsTree, you agree to our Privacy Policy, Terms of Use, and the points below.
Cancellation & Refunds:
Classroom Training/Instructor-led Online Training
TrainingsTree reserves the right to postpone/cancel an event, or change the location of an event because of insufficient enrollments, instructor illness or force majeure events (like floods, earthquakes, political instability, etc.)
In case TrainingsTree cancels an event, 100% refund will be paid to the delegate.
If a cancellation is done by a delegate 5 days (or more) prior to the event, 8% of the total paid fee will be deducted and the remaining amount will be refunded to the delegate.
If a cancellation is done by a delegate within 5 days (or less) of the event, no refunds will be made.
Cancellation & Refunds: Online Training and profiles
If the cancellation is done by the delegate within 48 hours of subscribing, 5% of total paid fee will be deducted as administration fee.
If the cancellation is done by the delegate after 48 hours of subscribing, no refund will be made.
In case of third party courses (for example, MS® Project and MS® Share point), 50% of total paid fee will be levied as administration fee and cancellation charges will be levied on the total fee paid by the delegate. The remaining amount will be paid, if the cancellation is done within 48 hours of subscription.
No refund will be made to the delegate after 48 hours of subscribing to the course.
Refunds: Duplicate payment
Refund of the duplicate payment made by the delegate will be processed via the same source (original method of payment) in 5 to 7 working days post intimation by the customer.
Note: All refunds will be processed within 30 days of receiving the refund request.
Rescheduling
In case TrainingsTree reschedules the training event, the options available to the delegates are:
100% refund, if the rescheduled dates do not fit into the delegate’s schedule.
The delegate would have the privilege of rescheduling and attending a class in future at his/her convenience, at any location, on any date of a scheduled training.
The delegates, if they so wish, can send a replacement. However, this should be intimated to TrainingsTree Solutions at least 3 days prior to the event.
Whereas, if for some unforeseen reasons, a delegate wishes to reschedule his/her registration to a future date, a rescheduling fee is charged as mentioned below:
If the rescheduling request is received 7 days prior (or more), 10% of registration fee will be charged.
Please note that rescheduling will be subject to availability of seats.
If the request of rescheduling is received within 7 days or less, no rescheduling will be allowed. However, the delegate can send a replacement instead.
Confidentiality
Customer acknowledges that, in the course of activities under this Agreement, Customer will obtain information relating to TrainingsTree and the Service which is confidential in nature (“Confidential Information”), including, but not limited to, the Service features, pricing details, and other features and information about the Site’s operations. TrainingsTree acknowledges that it may obtain Confidential Information relating to Customer, including, but not limited to, Customer Courses. Each party (“Recipient”) agrees that it will not disclose Confidential Information of the other party (“Discloser”) without the prior written consent of Discloser unless such Confidential Information becomes part of the public domain through no fault of the Recipient, and that it will only use such Confidential Information for the purposes of this Agreement and in accordance with the Privacy Policy and applicable law. Each party acknowledges and agrees that due to the unique nature of the Confidential Information, there can be no adequate remedy at law for any breach of this section, and the Discloser shall be entitled to equitable relief in addition to whatever remedies it may have at law. Nothing in this Agreement is intended to limit either party from accessing or making available similar services or courses, including, without limitation, Customer’s (or Customer’s employees’) use of another online education site, or TrainingsTree from offering Users the opportunity to enroll in courses other than the courses available on the Customer Portal. If Customer offers any suggestions for changes or improvements of the Service, TrainingsTree shall be free to incorporate or use them without payment, and Customer hereby grants TrainingsTree an irrevocable, perpetual, royalty-free license to do so.
Termination
We may terminate Your use of the Products or Site immediately without notice for any breach by You of these Terms or any of Our applicable policies, as posted on the Site from time to time. We may discontinue offering any Product, Course, or Content at any time (which will terminate Your right to offer these Courses if You are an Instructor). You may terminate Your use of the Site or the Products at any time, either by ceasing to access them, or by contacting us at [email protected] (but if You are an Instructor then Students enrolled in Your Courses prior to termination shall continue to have access to them for the duration of the Course). We have no obligation to retain any of Your Account or Submitted Content for any period of time beyond what may be required by applicable law. Upon termination, You must cease all use of the Site, Products and Content. Any accrued rights to payment and Sections applicable and all representations and warranties shall survive termination.

By using the Products or communicating with Company, You agree that Company may communicate with You electronically regarding security, privacy, and administrative issues relating to Your use of the Products or these Terms. If Company learns of a security system’s breach, Company may attempt to notify You electronically by posting a notice on the Products or sending an email to You. You may have a legal right to receive this notice in writing. To receive free written notice of a security breach (or to withdraw your consent from receiving electronic notice), please write to Company at [email protected].
Governing Law and Jurisdiction
The Services are managed by TrainingsTree, which is located in#73 21st Main, Near BDA Complex Banashankari 2rd Stage State of Karnataka India.we may be shifted anywhere in India or within Bangalore. You agree that any dispute related to these Terms will be governed by the laws of the State of Karnataka and republic of India and subject to Bangalore jurisdiction.
